Terms of Service

Welcome to Hawaii Golf Time ("HGT," "we," "us," or "our"). By accessing our website at hawaiigolftime.com or hawaiigolftime.club, submitting content through our platform, or using any of our services, you agree to be bound by these Terms of Service. If you do not agree, you must discontinue use of this platform immediately.

1. Acceptance of Terms

By accessing or using Hawaii Golf Time, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are accessing the platform on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

2. Content Submission & License Grant

By submitting video content, URLs, images, or any media ("Submitted Content") through the Hawaii Golf Time platform, you grant Hawaii Golf Time and its parent company, Hawaii Stream LLC, a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to:

• View, review, and screen the Submitted Content for quality and appropriateness
• Clip, edit, remix, and create derivative works (including but not limited to short-form reels, highlight clips, and promotional materials)
• Distribute, publish, and display the derivative works on social media platforms including YouTube, Instagram, Facebook, TikTok, and any future platforms
• Feature the derivative works on the golf course's official social media channels, the Hawaii Golf Time network channels, and the Hawaii Golf Time OTT/streaming platform
• Use the Submitted Content for marketing and promotional purposes related to Hawaii Golf Time and participating golf courses
• Sublicense the above rights to participating golf course partners for the purposes described herein

You retain full ownership of your original content. This license does not transfer ownership of your content to Hawaii Golf Time. You are free to continue using, distributing, and monetizing your original content on your own channels.

3. Creator Credit & Attribution

Hawaii Golf Time commits to crediting content creators in all derivative works we produce. This includes tagging your social media handle (@username), linking to your YouTube channel or social media profiles, and including your name or channel name in video descriptions and captions. You agree that this attribution constitutes fair and adequate credit for the license granted above.

4. Content Review & Right to Decline

Not all content submissions are guaranteed acceptance. Hawaii Golf Time reserves the sole and absolute right to:

• Review and screen all Submitted Content before any action is taken
• Decline, reject, or remove any Submitted Content for any reason, including but not limited to quality, appropriateness, relevance, or technical issues
• Determine which portions of Submitted Content, if any, are suitable for clipping and distribution
• Prioritize certain submissions over others based on content quality, creator reach, or other factors at our discretion

Submission of content does not create any obligation on the part of Hawaii Golf Time to use, clip, distribute, or otherwise act upon the Submitted Content.

5. Content Standards

All Submitted Content must comply with the following standards. Content that violates these standards will be rejected:

• No profanity, vulgar language, or offensive commentary
• No inappropriate, violent, or sexually explicit material
• No harassment, bullying, or discriminatory behavior
• No content that violates the rules or policies of the golf course where it was filmed
• No content that infringes on the intellectual property rights of any third party
• No content that depicts illegal activity or dangerous behavior on the golf course
• Content must have been filmed at a golf course listed on the Hawaii Golf Time directory

6. Voucher & Rewards Program

Vouchers, certificates, credits, swag, and other rewards ("Rewards") are issued entirely at the discretion of Hawaii Golf Time and the participating golf course.

• Submission of content does not guarantee any Reward
• Rewards are only issued for content that has been reviewed, approved, and processed by Hawaii Golf Time
• The type, value, and availability of Rewards are determined by the participating golf course and may change at any time without notice
• Rewards may include, but are not limited to: discounts on future rounds, pro shop credits, merchandise, range balls, or other items
• For creators who are not returning to the golf course within a reasonable timeframe, a swag-by-mail option may be available at the discretion of the golf course
• Rewards are non-transferable and have no cash value unless otherwise stated
• Rewards may have expiration dates set by the participating golf course
• Hawaii Golf Time reserves the right to modify, suspend, or terminate the Rewards program at any time

7. Creator Representations & Warranties

By submitting content, you represent and warrant that:

• You are the original creator and owner of the Submitted Content, or you have obtained all necessary permissions and releases from any individuals appearing in the content
• The Submitted Content does not infringe on the intellectual property rights, privacy rights, or any other rights of any third party
• You have the legal right and authority to grant the license described in Section 2
• All information provided in your submission (name, email, social media handles, etc.) is accurate and truthful
• The Submitted Content was filmed at the golf course you indicated in your submission

8. Indemnification

You agree to indemnify, defend, and hold harmless Hawaii Golf Time, Hawaii Stream LLC, their officers, directors, employees, agents, affiliates, AI systems, software, contractors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your Submitted Content, your breach of these Terms, your use of the platform, or your violation of any rights of a third party.

9. Limitation of Liability

To the maximum extent permitted by applicable law, the HGT Parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, participation in the content collaboration program, reliance on any information, or interaction with any linked services, regardless of the cause of action or theory of liability, even if advised of the possibility of such damages. In no event shall the total aggregate liability of the HGT Parties exceed the amount you have paid to Hawaii Golf Time, if any, in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The platform and all content, services, and features are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Hawaii Golf Time does not warrant that the platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Golf Course Partner Terms

Golf courses participating in the Hawaii Golf Time program ("Partners") agree to separate partnership agreements governing the terms of their participation, including but not limited to monthly service fees, content clip processing fees, social media account access, and voucher/reward allocations. These Terms of Service apply to content creators and website visitors; Partner terms are governed by separate Partner Service Agreements.

12. Prohibited Uses

You agree not to:

• Use the platform for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any portion of the platform, other accounts, or systems
• Use automated means (bots, scrapers, crawlers) to access or collect data from the platform without express written permission
• Interfere with or disrupt the platform's infrastructure, servers, or networks
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Upload or transmit viruses, malware, or other harmful code
• Use the platform to send unsolicited commercial communications (spam)

13. Modifications to Terms

Hawaii Golf Time reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the platform after any changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

14. Governing Law & Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in the State of Hawaii, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

• Payment Processors: Stripe processes payments securely on our behalf

We do not sell your personal information to third parties.

4. Data Retention

No portion of this content may be reproduced, distributed, or transmitted without prior written permission, except as permitted by fair use under applicable law.

User-Submitted Content

Content creators retain full ownership of their original submissions. The license granted to Hawaii Golf Time (as described in the Terms of Service, Section 2) is non-exclusive, meaning creators are free to use, license, and monetize their content independently. Hawaii Golf Time's derivative works (clips, reels, edits) are owned by Hawaii Golf Time but will always include creator attribution.

Partner Course Content

Content created for partner golf courses (newsletters, social media posts, promotional materials) under a Partner Service Agreement is created by Hawaii Golf Time on behalf of the course. The Partner Service Agreement governs the specific licensing terms for each partnership tier.

Third-Party Content

News articles, scores, and other third-party content displayed on the platform are sourced from publicly available feeds and are attributed to their original sources. Hawaii Golf Time does not claim ownership of third-party content. Any use of third-party trademarks is for identification purposes only and does not imply endorsement or affiliation.

Affiliate Disclosure

No Expectation of Privacy

Golf courses are generally considered public or semi-public spaces. Individuals present at a golf course with active live cameras should have no expectation of privacy with respect to their appearance in the camera's field of view. Removal Requests
